After your registration you receive an email with an activation link. You have to click on this link to confirm your registration. You can only log in after this confirmation.

If you cannot log in to your account you can reset your password. Go to the login page ( and click on the "forgot password" link. This will open a window. You can enter your username or password and click submit.
This will send an email with a link to reset your password.

You can change your password by simply logging into your personal page and clicking on the tab "change password" (it’s on the left side of the tab field).

After your registration you will receive an email with an activation link. You have to click on this link to confirm your registration. Only after this confirmation your account becomes valid and you can log in to surf the thingarage platform. In case you cannot find the email with the link in your inbox, please make sure it didn't accidentally land in your spam folder. If you did not receive the link, please get in touch with us trough the support center.

Just write us a mail at the Support Center ( and we'll do that for you. Although it's a pitty!! Pease let us know if you need everything to be deleted (including all comments, ratings and ideas) or if you want us to suspend the account (previous comments, ratings and ideas will stay).

Intellectual property rights

Yes, you keep all rights to the idea/concept you've submitted. In case a client is interested in your idea/concept, there will be a licensing agreement

We hate to take ideas out of a project because we think that their is such a fine line between inspiration and copying but if you feel that you're idea is really too similar then please contact a Project Guide to asses the situation.

You must own the rights to the files you use to expose your idea. Be aware that, by using files you find on the web (3D models, images, videos), you may be violating someone's intellectual property rights. Before using any third person's images, you should ask for permission or buy license rights. Even when using borrowed, CC licensed or stock material, your submission must contain your own creative work. The files should always be used to expose your unique, creative concept. To be on the very safe side, it's best to use files YOU have created yourself.

Contest, project and ideas

Each project on thingarage is under the management of one Project Mentor. You can see who this person is by checking the briefing page. Contact the guide whenever you have a concern or question regarding that particular project. The Project Mentor will also update you on new info or feedback from the client by leaving a comment under the briefing.

The following formats can be uploaded: 3D model formats: STL, OBJ, 3DS, X3D, Collada, VRML2/97 Image formats: jpg, png, gif. PNG guarantees best quality. Maximum size: 2 MB Video formats: mp4, mpg, avi. Maximum size: 20 MB An idea has to have at least one attachment.

The community members, expressing his approval rating on social networks, themselves decide who deserves to win the community prizes. Additionally, in some projects there is a Professional Jury that can award extra prizes.

You are free to rearrange the order of attachments or to upload more attachments to your idea at any time. Please request to delete your idea only in special cases (if there's, for instance, a problem with intellectual property, if it may come across as offensive, etc.)

thingarage is all about creativity. However, thingarage reserves its right to remove ideas that feature inappropriate content and/or are intentionally provocative.

thingarage is an international community, not all of its members' speak the same language. Therefore English would be strongly recommended.

One of the best things of thingarage is the fact that you have more freedom in developing your idea! With thingarage you can try things out, experiment with ideas, and let your creativity spread free. Of course, this doesn’t mean that the briefing is irrelevant. We will always advise you to take the briefing into consideration carefully. But you should also feel free to surprise us and the client if you have a brilliant idea.


The thingarage voting system is based on collective intelligence: the votes of many determine the best ideas. 
The more community members rate ideas, the better. This way, subjective preferences are balanced out and the ideas preferred by the majority of the users are ranked highest.

Good rating behaviour amounts to:

  • rating as many ideas as fair and objective as possible
  • understanding that it's important to leave aside personal taste and judge an idea based on

the main Rating Criteria Principles:

  • innovativeness
  • creativity
  • on-briefness
  • technical skills (applied by the author)
  • presentation

Try to remember: don't rate people - rate ideas!

  • Don't rate if you can't stay objective. Try to always have in mind the Rating Criteria Principles.
  • Supporting Ideas of friends. May the best idea win, and not the one with the most friends.
  • Supporting always the same designer: Let's not think and act in cliques - open up and cherish everybody's good ideas.
There are several ways with which we ensure fairness:
The community: you guys are the best watch dog. Talk to each other and contact members personally (eg via private message) if you feel like they don't rate fairly. You can also alert us via email at
The rating monitoring system: thingarage developed special monitoring algorithms that detect suspicious rating behaviour and alert the community management. The rating monitoring system analyses rating behavior statistically under different aspects.
As an example, the ratings of a user are reduced to a set of indices, expressing diversity and bashing tendency, amongst others. Also, efforts are made to identify micro communities and cliques which tend to rate each other favorably.
The coupled index of all such indices is called fairness index and is a measure of the users tendency to vote fairly.
Communication: in case the rating monitoring system detects suspicious rating behaviour we contact the community member via private message. It's nice to be nice and we hate to act like bullies. Hence, we rather convince people of the thingarage philosophy by talking to them - it's the best longterm strategy!
Punishment: in case the rating behaviour is not changed to the better after we contacted the community member. There are two ways:
  • Deactivate project related rating status: ratings in a specific project are deactivated. Sometimes community members are carried away by too much competitiveness - they usually rate fair but loose objectiveness when they are too involved in a project. We don't show this status in a community member's profile because we don't like public shaming.
  • Deactivate global rating status: ratings in all projects don't count. There are some people who just don't know better. We display this status with a light box in the community member's profile to make a stand.

The client decides regardless of the community rating. But of course the final result is a decision-making aid – so many professionals can’t be wrong!
Experience shows that most "sold ideas" ranked good to excellent in the community ranking. The wisdom of the crowd works!

No, you don’t need to comment, you can just cast your vote. But of course it would be only fair to leave some constructive feedback especially, in the case of a negative rating.

The more the better!
Rate the ideas you like. This way, subjective preferences are evened out and it becomes apparent which idea is preferred by the majority of users. Even if you didn't submit an idea in a project, rate away. thingarage is based on a lively exchange of opinions between the designers. Therefore, it’s important that the designers assess the quality of an idea by rating it. The rating provides feedback for the creator of an idea and helps with the creative process.

Terms of service


Thingarage is a platform designed for providing services in favor of people interested in evaluating and promoting ideas based on trends and styles of product design, managed by Thingarage S.r.l. (Thingarage), an Italian company having its registered offices in Via Giovanni Giolitti n.34, Rome, Italy.

Thingarage is, as well, an online marketplace for product plans that provides designers with the manufacturing services to turn ideas into real products, sellers with the web commerce services to sell their products and product plans, and buyers with the ability to purchase products and product plans direct from the source.

Designers retain ownership of all their intellectual property rights for their products and product plans. Apart from a limited license to display theproducts and product plans on our website, we are not given any interest in them.

Users, visitors and anyone who uses (the "Portal") are subject to the Terms and Conditions set out below, as well as to the relevantPrivacy Policy. In this document we generally refer to you ("You") as anyone who uses the Portal and, after his/her first visit has started using theservices and functions therein provided, thereby signifying agreement to these terms and conditions of use.

Registration is required to use all interactive features available on the Portal, such as posting comments, participating and creating contests, voting,submitting Project Ideas (as defined below) and, in general, for any operation and function of the Portal in which You provide information to Thingarageabout Yourself.

You must be 18 years old or older to register with the Portal: Thingarage will not accept underage registration, nor is Thingarage capable of monitoringbehavior of its registered users. Users (defined below) who shall accomplish an underage registration, shall do so at their own personal risk, andThingarage will not accept any kind of liability on the matter and reserves every right to take any appropriate action and/or, in general against illegal activity on the website and Portal.

To register a User account on Thingarage, You will be asked to provide "Personal Information" such as username, password, email address, Month and Year ofbirth and other personally-identifying information according to the Privacy Policy which You should read before completing the registration and are required to accept in order to register with Thingarage and print out for Your future reference.

All data shall be treated only for the purposes allowed by Law, according to the aforementioned Privacy Policy of Thingarage, which may update from time totime.

Now therefore, with the Registration, the User, having taken due notice of the above, which is entirely accepted, agrees to the following


  1. Definitions

    For the purposes of the present Terms and Conditions the following definitions will apply:

    • "Portal": the website at URL or at any other URL where Thingarage S.r.l. chooses to provide the Thingarage service as communicated to Users from time to time.
    • "User": a User of the Portal, registered, who has successfully completed the registration procedure;
    • "Designer": a User who submits a Project Idea(s);
    • "Promoter": a user who submits a Contest;
    • "Project Idea(s)": sketch (es), image(s), design(s), 3D model(s) or artwork(s) and relevant descriptions and data which a User submits to participate to contests and be evaluated by other Users or by Thingarage;
    • "Content(s)": any and all content of the Portal, including trademarks, service marks and logos, except Project Ideas but including software and HTML/Flash and any other type of code used on the website;
    • "Credits": units which are credited to the account of the User after a payment has been made to Thingarage and are used by Thingarage to pay the account of the other User as remuneration to the Project Idea which has resulted first in the ranking of the relevant contest. Units may also be directly used by Users to obtain certain services of the Portal where specified and/or where is so provided, redeemed in EURO by User who have more than 10 Credits on their account (1 Euro per each Credit).
  2. Access to Portal

    2.1. After registration as a User, Thingarage hereby grants You permission to use the Portal as set forth in these Terms and Conditions, provided that:

    - You will not copy or distribute any part of the Portal or Content or Project Idea in any form without Thingarage's prior written authorization;

    - You will not alter or modify any part of the Portal other than as may be reasonably necessary to use the Portal for its intended purpose under the present Terms and Conditions;

    - You will not utilize any third-party software, code or hardware to alter or modify any Part of the Portal and/or its underlying mechanisms.

    2.2. If You do not agree with any part of this document and/or the associated Privacy Policy, You should immediately discontinue use of the Portal and are not authorized to register. If You have already registered, You should contact Thingarage and ask for immediate removal of Your account which is not valid. Use of the Portal against this article 2 will force Thingarage to discontinue Your account and/or adopt any legal action necessary.

  3. Intellectual property rights

    3.1. The Contents available on the Portal are owned by, copyrighted, registered as intellectual property or otherwise licensed to Thingarage and generally protected by intellectual property rights as provided by this Article 3. Content includes registered intellectual property of Thingarage protected under International Treaties. It may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any purpose whatsoever, without the prior written consent of Thingarage or as expressly provided herein. Thingarage reserves all rights not expressly granted in and to the Portal and all relevant Contents.

    3.2. Project Ideas are property of their respective owners and their intellectual property rights are managed by the User who has uploaded them to the Portal, any relevant infringement shall be notified to the uploading User using the contact procedures available on the Portal. Any Project Idea You provide in connection with this Portal shall be deemed to be provided on a non-confidential basis.

    3.3. Thingarage retains the right, in its sole and absolute discretion, to monitor, edit, prohibit, or remove any Project Idea, at any time, without prior notice, for any reason. This right of Thingarage shall in no context be interpreted as Thingarage's obligation to monitor the accuracy and quality of the Project Ideas.

    3.4. Save for what is otherwise provided in Articles 3.1 and 3.2 above, all sections and Contents of the Portal may be subject to copyright and other intellectual property rights under the Laws of Italy including law April 22, 1941 no.633 and legislative decree February 10, 2005 no.30.

    3.5. Each User agrees to grant to Thingarage an unlimited license to freely use any text, data, photographs, renders, projects, maps, technical specifications, video, sound, messages and any other element protected by intellectual property rights, posted during the course of a contests, provided there is appropriate attribution of authorship and indication that the material is copyighted and was posted during a Thingarage contest. The license extends to use in Thingarage promotional materials including the website, electronic and printed marketing material and advertisements. The license applies from the date a Project Idea is uploaded and continues for a period of 6 months after the Project Idea is removed.

    3.6. Granting a license to Thingarage does not restrict your rights to grant the same or similar rights to other persons while these terms apply. Thingarage will not, without first obtaining your express authorisation, publicly display or distribute to third parties the technical specifications of any product plan that you upload to the website. For the purposes of this section, technical specifications include CAD drawings and other computer design formats.

    3.7. You must inform us of any change in ownership to a product plan or part thereof.

    3.8. You agree not to engage in the use, copying, or distribution of any of the Content and Project Ideas other than expressly permitted herein, including, but not limited to, any use, copying, or distribution of same, for any purposes to the maximum extent allowed by applicable Law. When downloading or when printing a copy of the Content or Project Ideas, using the links/functions provided and in the allowed formats, for personal use, You must retain all copyright and other proprietary notices and watermarks and/or digital rights management systems and/or digital content information contained thereon. Any behavior of the User shall respect the Law and regulations of Italy and any other applicable Law/Jurisdiction. Actions (copying, download, printing, transcoding, creating derivative works, etc.) which are not expressly allowed by supplying dedicated functions in the Portal are expressly prohibited and will be prosecuted under the Law.

  4. Project Ideas

    4.1. Designers can participate to Contests (as defined in Article 6) by uploading their Project Ideas in the appropriate participation slot, set up and provided for each Contest.

    4.2. Project Ideas, including, but not limited to, any text, data, photographs, renders, projects, 3D models, maps, technical specifications, video, sound, messages, relevant files which are adequately described and indexed or other material uploaded by Users as part of Project Ideas are intellectual property of the Designer which posts the Project Idea and are not in any direct or indirect way endorsed by Thingarage; Thingarage makes no express or implied guarantee, to the maximum extent allowed by applicable Law, regarding the reliability, accuracy, quality or feasibility of any Project Idea on the Portal. Contents of a Project Idea remain sole and exclusive responsibility of the User who has uploaded the Project Idea (please see also Article 11.8).

    4.3. Promoter who obtains a Project Idea understands that Thingarage does not provide feasible solutions but is only intended as a mean to obtain general indications which may guide the User in researching a solution on the market with the assistance of a qualified professional.

    4.4. Users understand that the service of Thingarage is not in any way meant, finalized or to be used as a tool or system to organize, negotiate or mediate for professional engagements. Thingarage will ban any account where such practices occur and will not credit any sums thereto. Thingarage provides no services which fall under the definitions of Article 1754 of the Italian Civil Code.

    4.5. Project Ideas are entered on the Portal without any obligation for Thingarage to keep them available for any specified period of time after the relevant contest has ended or, even before and without any prior notice, if issues regarding the Project Idea in question arise. By way of example and without limitation, Thingarage, may delete any Project Ideas at its complete discretion, in whole or in part, if it receives alerts /complaints/orders and/or; it deems so appropriate to protect the Portal and/or; has otherwise reason to do so.

    4.6. You acknowledge that Project Ideas may be based on user generated contents, according to the above, and, thus, the use of such type of content has to be carried out with the precautions associated with non professional-quality material and non certified designs/specifications.

    4.7. Thingarage does not in any case accept liability concerning the degrees and/or professional qualifications of Users of the Portal which may not always be independently verified with the local association in case any user of the Portal deems necessary to make a decision in which certainty of this kind of information is relevant.

  5. User Accounts

    5.1. In order to access all the features of the Portal, You will have to register and activate a User Account. You are not allowed to use another User's Account, as unauthorized use constitutes infringement of the Law. When registering Your account, we require You to provide us accurate and complete information. You are solely responsible for the activity that occurs on Your account, therefore You must keep Your account credentials secure; failure to do so will result in Your liability for any activity on Your account using Your login data. You may change Your password at any time by updating Your Account Profile page. In addition, You agree to immediately notify Thingarage of any unauthorized use of Your password or account or of any other breach of security You may experience. Thingarage will not be liable for any loss or damage arising from Your failure to comply with this Article 5, nor will it be liable for breach or unauthorized access or any other event depending by its User's behavior. Furthermore, Thingarage may discretionally decide to terminate and/or suspend any User Account, even without prior notice, if it deems so necessary to protect its business interests and/or similar reasons and/or is ordered to do so by any competent Authority.

    5.2. You agree not to use or launch any automated system, including without limitation, "robots", "spiders", "automatic form fillers" or similar technological devices or programs, that access the Portal in such a way as to send a series of request messages to the Thingarage servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, Thingarage grants the operators of public search engines permission to use spiders to copy materials from the Portal for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials (no Project Ideas will be made available for indexing, outside of the Portal). Thingarage reserves, in any case, full right to revoke these exceptions either generally or in specific cases, in its sole discretion.

    5.3. Thingarage permits you to associate your User Account with your LinkedIn, Facebook, Twitter, or other social network account ("SNS"). When you establish a linked account, you can sign into the SNS and automatically sign into the Portal at the same time. Thingarage is not responsible for the operation or functionality of any SNS. LinkedIn is a registered trademark of LinkedIn Corp., Facebook is a registered trademark of Facebook, Inc. Twitter is a registered trademark of Twitter, Inc.

    5.4. You accord that the Thingarage, within the purposes of its business, has the absolute right and permission to use your name, voice, image, representation and your applicable user compensation information, including for example any commissions paid and your influence percentage, as well as representations made by you, in any media, world-wide, for the intentions of advertising, promoting, reporting and distributing information about the Company or Company's business.

  6. Contests

    6.1. Promoters can introduce specific Contests, by paying the amount better defined as at Article 6.2 below, to ask Users to submit Project Ideas based on a certain set of requests and problems to work on ("Brief").

    6.2. When creating a Contest, a Promoter shall:

    1. ensure Thingarage a sum deposited equal to the Remuneration (as Article 6.3) to be paid to the Designer which will be paid to the User(s) of the selected Project Idea(s);
    2. pay any fees and charges imposed by Thingarage (as they exist from time to time) (hereinafter, "Thingarage Fee")
    3. pay any other fee retained by Thingarage for service costs, taxes and expenses, after deduction or payment of the above amounts.

    6.3. Once terminated the Contest the Promoter shall pay Thingarage the Remuneration – which is the actual amount, net of any applicable withholding tax and/or duty – to be paid to the Designer which will be paid to the User(s) of the selected Project Idea(s). The Promoter, once paid the Remuneration, will have its deposit released.

    6.4. Each Brief shall be associated to a Remuneration which shall consist in a certain amount of Credits, fixed by the User who launches the Contest with a minimum of 10 Credit, to be attributed to the account of the Designer which shall be the author of the Project Idea selected to better fit the Brief.

    6.5. Once prepared and uploaded to Thingarage with the payment of the relevant fees for starting the Contest, the Brief may not be modified by the Promoter who launched a Contest.

    6.6. During the Contest, participating Designers shall, in any case, be allowed to use a dedicated Question and Answer (Q&A) Module to interrogate the Promoter who launched the Contest on specific details on the Brief. All Q&A shall be public, so that all other competing Designer can benefit from the information provided by the Promoter. It is, however, forbidden to utilize the Q&A Module to directly contact the Promoter who launched the Contest and exchange direct contact information. Any User posting requests and/or his contact details on the Q&A Module shall be banned from the Contest itself and the relevant account with any credit accrued shall be terminated, without prejudice to further actions as provided by Articles 13 and 14 below.

    6.7. The Contest shall be time limited (from a minimum of 7 days to a maximum of 1 month) and, once closed, will be decided following one of the procedures below, depending on the type of Contest in question:

    1. "Basic contests": the Promoter creating the contest, when requested to do so by Thingarage's automated system, shall assign a score to each Project Idea; once all Project Ideas are evaluated, Thingarage's automated system will generate a ranking list of the Project Ideas, ordered by vote; at the same time, the Promoter will be allowed to view a list of the most voted Project Ideas in his Contest, ordered by number of votes; should the Promoter creating a Contest fail to confirm the contents of the auto-generated ranking list, the top Designer of such list will be automatically selected as winner in ten days since Contest completion date, and he will be awarded the Remuneration; should the Promoter creating a Contest fail to create a ranking list at all, the system will automatically select the winner, based on the ranking obtained from other Users' votes, and the Remuneration shall be assigned in ten days from Contest completion date;
    2. "User-selected contests": the Promoter creating the contest specifically waives his right to choose the winning Project Idea; the winner of the Contest will be directly selected by the votes by other Users in ten days from Contest completion.

    6.8. Should the Promoter deem appropriate, for any reason, to stop the Contest in advance, or to make a claim against its results and request back the Remuneration, he will have 10 days from Contest completion to file a detailed complaint with Thingarage, explaining his reasons and providing all data regarding the matter. The decision on the complaint will be taken by Thingarage, at its sole discretion. In this case, Section 6.9 below will apply to sums deposited because of the revoked mandate.

    6.9. The User creating a Contest expressly confers Thingarage full and irrevocable mandate, as per Section 1703 of the Italian Civil Code to

    1. receive as trusted depositary the sum of money which is paid by User as amount of the Remuneration, and
    2. as soon as the winner of the Contest is determined, pay in the name and on behalf of the Promoter the Remuneration to the Designer whose Project Idea is selected at the end of the Contest with the criteria contained in these Terms and Conditions. For the avoidance of doubt, the User to which the Remuneration is to be paid is the one whose name is published on the Portal in the section which refers to the relevant Contest. It is understood between the Parties that such mandate shall be subject to the precedent conditions of (i) creation of a contest as per article 6.2 above and (ii) full payment of the relevant sum by the User who creates the Contest as per article 6.3 above and (iii) acceptance of the Remuneration by the winning User.

    6.10. As provided by Article 1725 of the Italian Civil Code, mandates conferred to Thingarage as per section 6.9 above, may not be revoked once the relevant contest is introduced by the User, unless the contest itself is cancelled by Thingarage if the client not received any project, the client will have the right to ask the refund of Remuneration of the contest with the exception of the Thingarage fee, transaction fee and costs for money transfer.

    6.11. After the winner of the contest is selected as per Section 6.7 above the mandate may not be revoked by User, unless the winning User has resulted in grave violations of these Terms and Conditions.

    6.12. If no Project Idea is submitted by the Users during the User chosen time, then the Remuneration will not be assigned and the Credits could be redeemed by the Users.

    6.13. Thingarage will not have any part during the eventual execution phase of the Project Idea(s) and no responsibilities could be claimed against Thingarage concerning the specifics of the selected Project Idea(s).

  7. 7. Credits

    7.1. All goods and services provided on the Portal shall be paid for using a system of vouchers called "Credits" which may be obtained at the price of 1 Euro per Credit at the Thingarage store on the Portal.

    7.2. Credits can be purchased at any time by Users and paid for by means of Credit Card, PayPal, or any other method of payment specified from time to time by Thingarage.

    7.3. The minimum value of a Credit is 1,00 Euro. Should any Credit value be of less than 1,00 Euro, the amount will be rounded to the nearest Euro.

    7.4. Credits are not, by any means, a legal currency and cannot be traded or sold to third parties. No User to User transaction of Credits will be recognized by Thingarage. Only Credits directly assigned to the User by Thingarage will be recognized as valid.

    7.5. Credits are only exchangeable for goods and services provided by Thingarage on the Portal, in accordance with these Terms and Conditions and with the pricing and rules specified by Thingarage from time to time.

    7.6. Thingarage might reduce the balance of Credits of any amount You owe to Thingarage on any whatsoever account, including compensation of Thingarage for any loss that it determines (at its sole and absolute discretion) to have suffered as a result of any breach of this Terms and Conditions by You.

    7.7. Users may at any time convert Credits which they hold in their User Account to Euro or any other currency permitted by, and request payment of those amounts, provided they have at least 10 Credits. Any such payments will be made via the payment method specified by Thingarage and selected by the requesting User.

    7.8. All payments issued by Thingarage to a User may be reduced by any amount owing by the relevant User to Thingarage on any account whatsoever and may also be reduced by any related administration fees and charges imposed by Thingarage.

    7.9. Should any payments be issued to a User in a currency other than Euro they will be issued at an exchange rate determined by Thingarage in its sole discretion, based on real-time bank data. You will bear all risk in relation to any loss You may make as a result of the exchange of Euro to another currency.

    7.10. Thingarage may refuse to permit You to withdraw Credits where it considers that as at the date of withdrawal You are in breach of these Terms and Conditions.

    7.11. You agree that You will not enter into any arrangement and/or agreement with an User to pay any amount in excess of the above mentioned fees (please see Section 6.2) for the Project Idea or to pay him/her separately outside in relation to the supply of a Project Idea, or of any services that are the subject of an invoice issued by Thingarage to You.

    7.12. The balance of Credits held by You will expire 12 months from the date that You last spent any Credits to create new Contests on the Portal. Balances of Your Thingarage which are not spent in the creation of contest and/or other available services within this 12 month period are lost.

    7.13. Thingarage is not a storage service and does not hold files, intellectual property, money or any form of property as a deposit, escrow or similar on behalf of any of its Users. All amounts deposited or paid to Thingarage are property of Thingarage and Thingarage may use those funds as it sees fit. The only rights that You have to receive payment of any amounts held by Thingarage are as set out in these Terms and Conditions.

    7.14. Any mandates as per Section 6.9 which will be still in place after 12 months since a contest has ended and no User has claimed the sums, shall be considered as revoked. User will then pay to Thingarage a sum equal to ….% of the sum deposited as additional cost of the mandate.

  8. Invoicing and Taxes

    8.1. Each time a Customer creates a new Contest, Thingarage will invoice him/her, as per applicable laws and regulations, on the Thingarage Fee ex Section 6.2, § (ii).

    8.2. You agree that You are responsible for the collection and/or payment of all taxes which You may be liable for in any jurisdiction arising from Your Contests on Thingarage is not responsible for collecting, reporting, paying, or remitting to You any direct/indirect taxes and/or social security charges.

    8.3. The winning Designer shall have the duty to invoice the Promoter, as required by applicable laws and regulations, including tax and social security laws and regulation, for the sums received as Remuneration. Thingarage shall not be required to supply relevant information thereto and/or advise the User on the matter. Thingarage will not accept liability for any error/omission/failure to comply in any manner by the User to this Section 9.3.

  9. User Warranties and liability

    9.1. The use of this service is entirely at Your risk and You take the full and sole liability of it.

    9.2. You guarantee to Thingarage to be the exclusive owner of the Project Ideas You upload on the Portal or to have pre-emptively got the necessary authorization from the owners of the rights concerning third party works or contents inserted into the Project Ideas uploaded by You on the Portal.

    9.3. You are therefore the sole responsible for anything uploaded on the Portal using Your ID and/or Your password and anyway, for any behavior or action set through it on the Portal.

    9.4. As registered User, You commit Yourself not to publish Contents: - pornographic, obscene, or paedophiliac; - that cause in any way damage to minors; - blasphemous or offensive to the morals, ethics and to any religious belief; - with purposes against public order, that sing praises to violence or racial hate; - illegally detained or bought by the User (pirate software, unauthorized copies, etc.); - advertising or promotional in favour of subjects different from the brand object of the campaign on Thingarage to which the Content is uploaded; - tied up to the gambling, competitions, games that ask for a money participation; - protected by copyright, whether being audio, text, images or fragments of video without obtaining the previous authorization from the rights holder; - that are damaging to third parties, with particular reference to copyrights or other rights of intellectual and industrial property; - that contain virus or other software that may damage or influence the functionality of the site; - that promote or induce to illegal activity; - that contain utilizations of images fixed or on the move, of common and/or famous people, or that refer to these without their previous authorization; - that contain deceptive or comparative advertising messages as by law in force; - that violate, or induce to violate, any law or regulation.

    9.5. It is particularly forbidden to use the service to cause in any way prejudice to third parties or to commit or to encourage any kind of crime.

  10. 10. Children's privacy

    10.1. Protecting children's privacy is especially important to us. It is our policy to comply with Italian laws on the matter.

    10.2. Thingarage does not operate or provide services directed toward children and does not intentionally collect information from children. If You find any content on our Portal offensive or otherwise disrespectful towards minors, we ask You to contact us immediately, providing all details, so we can operate for its fast removal.

  11. Warranties and liability of Thingarage

    11.1. The Portal and all related services are offered by Thingarage to the User "as is", and "as available", without any warranty, be it direct or indirect, of any kind on its contents and/or its functionalities. Thingarage S.r.l., therefore, does not offer any warranty on the accessibility of the Portal in any moment and/or place, nor does it offer warranties over the absence of defects and/or errors in the Portal and/or in its contents.

    11.2. Thingarage shall not be considered responsible for any eventual damage which will might derive You, or your PC, by the incorrect use of the Portal and of the services therein.

    11.3. Thingarage shall be liable only when the User can effectively demonstrate that Thingarage S.r.l. (a) adopted an intentionally harmful conduct; (b) acted in gross negligence; (c) has violated any applicable provisions of law regarding responsibility over licensed products. Thingarage S.r.l. may be required, under existing laws and regulations, to pay damages resulting from injuries that have affected life, physical integrity or health of the User, provided it is demonstrated that these events are a direct consequence of the behavior of Thingarage S.r.l.; in no case Thingarage S.r.l, shall be held liable for slight negligence acts. The above limitation of responsibility shall apply also to the mandate conferred as per Article 6.9 above.

    11.4. The User accepts to indemnify, defend and protect Thingarage against each and any claim, demand, claim for damages or other losses, including reasonable attorneys' fees, claims by any third party arising from the use of the Portal and/or by violation of these Terms and Conditions.

    11.5. Pursuant to the provisions detailed above, Thingarage will not be liable for service interruptions due to: - natural catastrophes or fortuitous event; - tampering on the services or on the equipment, carried out by the User or by third party; - wrong use of the services by the User; - faulty operation of the connection devices used by the User, even when it is due to the non-observance of the laws and rules on safety, prevention, accidents and industrial injuries.

    11.6. Thingarage has no obligation to oversee any contents circulated through the service, nor has it any obligation to actively seek facts or circumstances that point out the presence of illegitimate activity without an appropriate order to do so by a competent Authority; Thingarage is therefore not responsible in case of possible controversy on the legitimacy, truthfulness, correctness, quality, originality and paternity of the material published on the Portal, including, but not limited to, Project Ideas; Thingarage will take prompt action to remove the contents manifestly non compliant with third parties rights, as soon as it receives a direct complaint, provided with all necessary data to evaluate a violation (such as: link of offending content, information about copyright violation, etc.).

    11.7. If Thingarage becomes aware of the illegitimate or prejudicial feature of the Project Ideas published online by the User, it will immediately, and at its own discretion, remove the offending information and/or disable access to such data.

    11.8. Thingarage, in any case, will not accept responsibility for possible violation of intellectual rights on contents by third parties, as well as for the possible loss, cancellation or alteration, momentary or definitive, of Project Ideas for any cause. Each User contributing material to the Portal does so at his/her own risk, and shall face any and all consequences of such behaviors, thus indemnifying Thingarage as per article 13 below to the maximum extent permitted by applicable Law.

  12. Malware and connections to third party sites

    12.1. Thingarage has committed itself to maintain the Portal without viruses and malware, but cannot guarantee its full immunity from them. The User has therefore to adopt suitable safety measures and has to use an antivirus program to avoid the loading of virus on his own software. In case of hypertext link to third sites, Thingarage does not have any responsibility for the possible illegitimate content of these, neither some obligation of control them.

  13. Indemnification

    13.1. The User is obliged to release any liability and to hold Thingarage, as well as its affiliates and its representatives, its agents, its employees and third parties to which Thingarage has granted rights on the uploaded materials, free from all the losses, damages, responsibilities, costs, burdens and expenses, including the possible legal expenses that might be suffered or sustained by Thingarage as a consequence of any publication and/or use of the Project Ideas uploaded by the User on Thingarage, and/or of any default from the User of the obligations and warranties written in this contract and however connected to the use of the service, also in case of compensation for damages claimed by third party.

  14. Service suspension

    14.1. Thingarage retains full right to remove, without notice, the account of the User and any content produced and published by him that violates the conditions of these Terms and Conditions.

    14.2. Removal might occur also in case of content reported as abusive/unlawful/copyrighted by other Users or third parties to Thingarage. In such cases, Thingarage shall also retain all rights to compensate any damage occurred with the infringing User, as per article 13.

  15. Removal of the account for inactivity

    15.1. If the User does not use the services provided by Thingarage for a period of 24 months in succession, Thingarage will have the right to disable his access to the site, retaining all Credits not converted at the date of account removal.

  16. Changes of terms and conditions of use

    16.1. Thingarage retains the right to modify these terms and conditions in every moment and without any previous notice. In using the service, the User has to completely accept the new conditions.

  17. Contract termination

    17.1. According to article 1456 of the Italian Civil Code this Contract may be terminated with no prior notice in case of any breach of the above terms and conditions. In such case Thingarage shall not be liable of any indemnification to the User. At the same time the User shall be liable for losses, damages and other indemnifications to Thingarage, arising as a consequence of the breach.

  18. Contract conservation

    18.1. Should one or more of the provisions of these Terms and Conditions be declared null, void, even in part, the remaining part shall maintain its validity and Thingarage will amend the Terms and Conditions adequately.

  19. Applicable law and competent Court

    19.1. These contract shall be governed by the Laws of Italy.

    19.2. For any disputes arising because of or under the above Terms and Conditions the Courts of Law at Rome, Italy shall have exclusive jurisdiction.

    19.3. The use of Portal/services thereon is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.

    According to article 1341 of the Italian Civil Code, the User has read and accepts the terms contained in Articles 4, 6, 7, 8, 9, 10, 11, 13, 14, 15, 16, 17, 18 and 19.

Abide by a policy of transparency and propriety, in compliance with current regulations and with particular reference to the Legislative Decree 196 of30 June 2003, (hereinafter, the “Personal data protection Code”), Thingarage Srl (hereinafter, “Thingarage”) hereby provides you with some informations about the processing of personal data provided by you in the use of the services related to the website

It is noted that, pursuant to Article 4, paragraph 1, letter a) of the Personal data protection Code, processing shall mean “any operation, or set of operations, carried out with or without the help of electronic or automated means, concerning the collection, recording, organization, keeping, interrogation, elaboration, modification, selection, retrieval, comparison, utilization, interconnection, blocking, communication, dissemination, erasure and destruction of data, whether the latter are contained or not in a data bank”.

    • Collected data will be processed by Thingarage, wihout (no required) any express consent by you, pursuant to Article 24, paragraph 1 of the Personal data protection Code, for the following purposes:
      • to provide the services displayed on the website, managed by Thingarage, although it may be linked to other websites in a co-branding, mainly aimed at the obtainment of business proposals for the design and the achievement of prototypes and objects made by direct digital manufacturing (3D printing);
      • to allow the cooperation between professionals and consumers, the professional advice, the providing of services , the research and the development in the field of 2D and 3D modeling, design, architecture, materials engineering, and graphics;
      • to purchase designs in order to produce or sell them;
      • to provide to those consumers-users (mainly design and additive printing companies) with which Thingarage has signed/will sign trade agreements or cooperation agreements, all the informations for the delivery of the services you have requested or that have been settled with you;
      • for the monitoring and prevention of fraud and unauthorized use of the service;
      • to verify the level of customer satisfaction of Thingarage and/or those companies (mainly design and additive printing companies) with which Thingarage has signed/will sign trade agreements or cooperation agreements;
      • to propose any new offers for the extension of delivered/produced services by Thingarage and/or by those companies (mainly design and additive printing companies) with which Thingarage has signed / will sign trade agreements or cooperation agreements;
      • to measure the effectiveness and the suitability of the service provided by the site
      • for the administrative management of the relationships, including the commercial relationships, between Thingarage and the third parties referred to in the previous paragraphs;
      • to answer comments and notices sent by the customers;
      • for administration and accounting purposes;
      • to fulfil legal obligations;
      Thingarage will not collect or process sensitive data (e.g. labor unions, political parties or other association memberships, health-related data).
    • Moreover, collected data will be processed by Thingarage, prior express consent, for subsequent commercial communications, offers of products or services, advertisement, market researches by Thingarage, not directly linked to your first request.
  • Data provision
    • Your data provision is compulsory (necessary), for the purposes described at paragraph 1.1, because failing your data, it will not be possible to deliver you the services you have requested; instead, for the purposes described at paragraph 1.2, your data provision is optional, therefore it will not be possible to send you subsequent commercial communications, offers of products or services and advertisement, as well as to do market researches by Thingarage, operations that are not directly linked to your first request.
  • Communication and dissemination of data
    • Data provided by you may be disclosed in accordance with the purposes described in paragraph 1.1 to the following persons:
      • companies that provide repairing, design, and 2D and 3D services, with which Thingarage has signed/will sign trade agreements for the execution of your instructions, or for the provision of the services requested by you (the updated list of companies and professionals in the field of 3D modelling is published on the following page;
      • service companies in order to acquire, record and process the data originating from documents and supports supplied or created by the users themselves, involving massive operations related to payments, effects, checks and other securities;
      • company in charge of auditing activities;
      • companies with which Thingarage signed/will sign agreements or collaborations aimed at the offer (commercial or not) of goods or services by such companies;
      • companies with which Thingarage signed/will sign agreements or collaborations aimed at monitoring and understanding the browsing mode on the website.
    • Likewise, data provided by you may be disclosed in accordance with the purposes described in paragraph 1.2, to the persons of the paragraph 3.1.
    • However, your data will not be disseminated, made available or given in any form to unspecified persons.

    • Data provided by you may be processed by third parties, if called up to perform processing operations on behalf of Thingarage, and for this aim specifically appointed as “external data processors”, such as, for an illustrative, yet incomplete purpose:
      • companies that perform activities of transmission, envelopment, transport and sorting of communications to the customers;
      • companies that perform services for filing the documentation related to the relationships with the customers;
      • companies of surveying about: the quality of the services provided, customer satisfaction, new product offerings, etc.;
      • companies that perform services related to the provision, measurement and optimization of websites and communication campaigns through the Internet.
      • persons who the administrative processing is outsourced to (for the legal, tax, labour law advice, pay slip managing, etc.)
    • The list of data processors is steadily updated and can be requested by sending a notice as described in paragraph 8.2.

    • Data provided by you may be transferred outside the state territory, pursuing the purposes referred to in paragraph .1 and 1.2, to companies belonging to the categories listed in paragraph 3.1, 3.2 and/or 5.2 having their registered office in Countries belonging or not belonging to the European Union.
  • Processing arrangements
    • The data processing can be made by using manual, computer as well as telematics instruments, suitable to data storage, managing and transmitting.
    • For the measurement of the effectiveness and suitability of the offered service Thingarage, also through third-party companies, collects informations from the web browser used by its users (IP address, operating systems, etc) and uses a technology (so called "cookies") able to understand the users’browsing mode. Cookies are data created by a server that are filed on the hard disk of user’s computer and that allow the website to be aware of the behaviors and users’ preferences. Cookies may be permanent-everlasting (“persistent cookies”), but may also have a limited duration (“session cookies”). Thingarage uses “session cookies” to allow you the safest and the most efficient website browsing, and these cookies are not permanently filed on the user's computer and they disappear at browser switch off. Thingarage also uses “persistent cookies” of variable duration, in order to keep user's preferences in case of a subsequent visit to the site, for example keeping the choices made by the user in a previous session. Each user can directly disable, at any time, the use of the "cookies" on the browser settings. However, Thingarage, points out that in case the users disable the cookies, he will not be able to browse all the pages of the site.

    • In order to object to the sending of advertising materials is also possible, at any time, fill in the online form and completing the simple shown procedure, or sending a delete request from the mailing service, with the indication of your own e-mail.
